Terms & Conditions

Below you will find my Terms & Conditions. It is assumed that you have read, understood and agreed to them before any order, wedding order or workshop.

I am fully registered, insured and my kitchen holds a 5* rating issued after inspection by the EHO. All the ingredients I use are excellent quality, fresh and purchased from responsible, reputable suppliers.

Allergies

You must note that although my cupcakes do not contain nuts, nuts are frequently used in my kitchen.  Therefore I cannot guarantee my cupcakes are nut free. Please ensure you check with your guests about any allergies they may have prior to ordering. I cannot be held responsible for any ingredient contaminated at source. Gluten Free orders MUST be made clear at the time of ordering. Food colourings contain various ingredients and additives. The manufacturers of these colourings cannot guarantee they are nut free due to the other products that are produced in their factories. Some of the E numbers may have an adverse effect on activity levels and attention in children. They are: E102; E104; E110; E122; E124; E129. A full list of my cake and buttercream ingredients and their allergens is listed here:

Your Cupcake Bouquet

Whilst I make every effort to recreate your chosen cupcake bouquet to the exact representation shown on the image in the gallery, due to the nature of the of the creation, every cupcake bouquet will always be subject to variation.

All cupcake bouquets are presented in a window box or bag and photographed, so you can check they are in perfect condition when you receive them.  I cannot be held responsible for any damage that may occur to it once you have collected/received your cupcake bouquet. 

If you collect your cupcake bouquet, you will need a flat space in your vehicle to place the box and keep it in an upright position. Please ensure you have a place to put it before you come to collect. I cannot be held responsible for any damage done to the cupcake bouquet whilst in transit. 

The cupcake bouquets need to be stored in a cool, dry place. They should not be left in a car or a fridge for any length of time. They should be kept away from extreme heat.  To enjoy the cupcakes at their best, they should be consumed ideally within 24 – 36 hours of receiving them. Please try to order your cakes to be received as close to the day they will be consumed as possible. I cannot guarantee their quality or freshness beyond this time and I cannot be held responsible if these conditions have not been correctly adhered to. It is your responsibility to ensure the recommended transportation and storage conditions are adhered to.

I ask for full payment in advance to secure your order. Payments are non-refundable and non-transferable. Quotes are valid for 2 weeks (14 days from the date the quote is given). Your requested date will be held for 24 hours. If the payment has not been made within this time, I cannot guarantee the availability of your desired date and you will need to re-check with me to confirm the order. Please make sure you book in plenty of time to avoid disappointment. I can sometimes take orders at short notice, but this is dependant on availability and the size of your request. Any changes to your order need to be requested at least 48 hours prior to the date you are due to receive your order. Such changes are at my discretion and may not always be possible.

Collection and delivery times will vary according to availability and location.  I only offer delivery when and if I am able to.  Please note that I work a full time job and need to take this into account when making arrangements.  You must ensure if delivery is arranged that you give the correct address details when placing your order. I will not be held responsible for orders that are undelivered because of incorrect or incomplete details given. Whilst I am prepared to leave your cupcake bouquet with a direct neighbour if you cannot be home for any reason at the time of our arranged delivery, this must be arranged with their consent.  I will not wait for such an arrangement to be made for any length of time after our agreed delivery time.  I will not be held responsible for any damage that may occur to the cupcake bouquet once it has left my possession. I am not prepared to drive to any other address other than the one specified on your order. Collection is from Hockley and I will bring the cupcake bouquet to your car when you are outside. Please note that during peek times (Christmas, Mothers Day, etc) there will be set collection times only. If your order is not paid for within 24 hours I reserve the right to cancel it. 

Non Edibles

If your cupcake bouquet/order contains non-edible items that are simply in place for appearance, you will be notified of these clearly when you receive your bouquet. It is your responsibility to remove these items before consumption and I cannot be held responsible if you fail to do so. 

Complaints

In the unlikely event that you have a complaint about your cupcakes, in order to assist in any way I MUST be notified and receive the cakes back within 24 hours of handing them over to you.  This enables me to see any issues myself first hand, as all cakes are made to order and fresh.  The utmost care is given to ensure every order is as excellent quality as it can be.  No refunds will be issued without this notification and the cakes back in my possession within 24 hours of you having them in yours. 

Unexpected Issues

I reserve the right to cancel orders in exceptional circumstances that are beyond my control, such as fire; family emergency/bereavement; ill health, etc. I’m not allowed to prepare or sell food if I am unwell. If these circumstances do happen to occur, you will be notified and a refund will be issued as soon as possible. 

WEDDINGS

All terms and conditions apply to weddings, including the following:

Consultations

If you wish to book a consultation, appointments are free of charge and last for approximately one hour. Appointments are limited to 3 persons maximum. To arrange an appointment please email contact@nicolajanecupcakebouquets.co.uk and request to book a consultation. I will be in touch with the diary within 48 hours so we can book the most suitable time. My sample boxes contain 3 cupcake flavours and cost £10

Payments

When booking your wedding cupcakes, I require a non-refundable holding fee of £100. This payment secures your order date and will be deducted from the total amount payable. The balance for your order must be paid in full no less than 4 weeks prior to your requested date. Once paid, work will commence on your cakes.  This payment cannot be transferred to any other product.  Payments must be made via bank transfer.  

Stand Hire

If you wish to hire one of my display stands for your event, they must be delivered and collected by myself, or persons appointed by myself to do so.  A hire fee of £50 applies.  A refundable deposit is required which is only refundable if no damage has occurred to the stand on collection.  If your venue damages the stand in any way this deposit will not be refunded and you are responsible to make a claim with them to cover your costs.  I will communicate with your venue to arrange a suitable time to collect the stands.

Set Up

Set up is a service that is included in the delivery costs. If you have chosen to set up yourself and have purchased a display stand from me or from your own source, you are responsible for the condition of your stand and cupcakes once they have left my possession. Photographs are always taken when the cupcakes are ready and packaged in suitable, strong boxes before they are collected. I cannot be held accountable for any damage to the cakes once they have left my possession. You are responsible for ensuring you have a suitable vehicle for transit of the cupcakes to your venue. How you display the cakes once at your venue is at your discretion. You are responsible for ensuring you have set up your stand correctly before placing your cupcakes on it. If purchased from me, your stand will have been opened and checked to ensure it is in perfect condition prior to collection. If you have added any non-edible decorations to the stand, it is solely your responsibility to inform your guests. You must not add any real flowers to or around the cupcakes, as many of them are toxic. It is your responsibility to ensure this does not happen.

Cancellations/Re-schedules

If your event/order is cancelled more than 21 days prior to the event date, I will refund 25% of the total amount paid. For cancellations made inside of this 21 day period, no refunds will be issued.  Any and all refunds are made at my discretion only. Any payments made, including holding fees/deposits cannot be transferred to any other products. 

As a small home business, your booking date is dedicated to and held exclusively for you and any changes of date requested cannot be guaranteed. If your proposed change of date cannot be accommodated, I will refund 25% of the total amount paid (terms as stated above apply). Changes of date must be made/requested within 6 months of the original date or the event is considered to be cancelled and needs to be re-booked.

Delivery & Set Up/Collection

I will deliver your order to your venue at the earliest possible time. Communication with your venue will be made by me to ensure the best time of delivery suitable. Deliveries are charged at 90pence per mile (both ways) from my postcode to the venue postcode. Any requests to deliver to areas with a 2hour+ journey will be charged at a daily rate of £150.   Delivery includes free set up. I am dedicated to making your cakes look as wonderful as possible at your event and ensuring they are left in perfect condition for you and your guests to enjoy. If it is not possible to set up your cakes at a convenient time, they will be left in the hands of your venue/banqueting team with full instructions.

I will always contact your venue directly to arrange the earliest possible set up time.  I take no responsibility for any unexpected events outside of my control that may affect your delivery – such as severe weather conditions, public unrest, traffic due to road accidents, closures etc. In such unlikely cases I will keep you and the venue updated and will endeavour to deliver as soon as possible.

If you choose to collect your cakes, they will always be boxed accordingly and full instruction on the care and handling of your cakes will be provided before your agreed collection time.  I take no responsibility for any damage that may occur to your cakes once they have left my possession. I do not take any responsibility for the presentation of your cakes once at your chosen venue. 

Online Tutorials Terms & Conditions

Any and all online tutorials purchased from Nicola Jane Cupcake Bouquets are subject to the following Terms & Conditions.  These terms and conditions are a binding agreement between you and Nicola Jane Cupcake Bouquets and it is assumed when you purchase a tutorial or subscribe to a membership on this website that you have read and agreed to them. 

This website offers a 30 day membership for all those who subscribe to receive edible art tutorials and other related content in exchange for a monthly fee of £5.99, which is automatically renewed.   Payments will then continue via recurring automatic billing every 30 days to the payment method entered upon subscribing.  Upon cancellation, all access to membership content will cease with immediate effect.  No refunds will be issued.   These same terms and conditions apply to the 3-Monthly Membership and the 6-Monthly Membership.

All membership content is for personal use only and you may not exploit any of the content of this website in any way.  The tutorials by Nicola Jane Cupcake Bouquets are protected by copyright law.  Any and all infringements of these Terms & Conditions will be followed up by Nicola Jane Cupcake Bouquets to the maximum of copyright law.

All tutorials and PDFs are for individual use only.  They are exclusively the intellectual property of Nicola Jane Cupcake Bouquets and must not be shared, used for group viewing, teaching purposes, commercial use, copying or onward sale.  You may not create reels or images for your website or social media accounts giving away any of the content of any tutorials you have purchased or subscribed to on this website. You may not give away tutorial details to anyone who may screen shot images requesting information on other cake decorating social media groups.  Any finding of this will result in immediate cancellation of your account.  Any and all intellectual content on Nicola Jane Cupcake Bouquets website is the intellectual property of Nicola Jane Cupcake Bouquets and may not be copied or used in any way.

Tutorials are in English only.  There are no subtitles.

You must be at least 18 years of age to purchase and accept the Terms & Conditions.  If you are accepting the terms and conditions on behalf of anyone in your legal care, you are legally liable and fully responsible for his or her use on Nicola Jane Cupcake Bouquets site.  All terms and conditions apply.

All prices are non-negotiable.  Memberships are priced according to tutorial content.  Prices are in GBP Sterling only.  Nicola Jane Cupcake Bouquets is not liable for any additional charges, taxes, import duty or any other costs which may be imposed.  It is your responsibility to check with your bank and/or relevant authorities prior to purchase.  

It is not possible to transfer ownership of a purchased tutorial or membership to any other recipient.  It is your responsibility to ensure all purchases are made through the applicable account email only.

All payments are non-refundable.  Tutorials are available to watch immediately after purchase.  Online tutorials are only available for viewing via logging into your account, which you will be requested to set up at checkout.  You are responsible for ensuring you enter the correct email address details.  Nicola Jane Cupcake Bouquets cannot be held accountable for any mistakes you may make, nor do they offer any technical help.  It is your responsibility to ensure you have access to your account and the necessary internet connections to view tutorials.  Nicola Jane Cupcake Bouquets will not be held liable for the failure of any equipment, data processing system or transmission link.  Nicola Jane Cupcake Bouquets will not be held liable for any downtime that may occur.

Tutorials are not available for download.

Nicola Jane Cupcake Bouquets reserves the right to remove any course from sale at any time.  If any updates are made to a tutorial you have purchased, you will have access to that update.  Whilst you are a member of Nicola Jane Cupcake Bouquets, you will have access to the tutorial for the lifetime of Nicola Jane Cupcake Bouquets. 

CANCELLATIONS

Members can cancel their membership at any time.  All cancellations are immediate, regardless of the next billing cycle date.  It is the subscriber’s responsibility to ensure they cancel their membership prior to this date.  No refunds will be issued if cancellation is made after or on the day of their automatic payment date.  To cancel a membership, subscribers must log in to their account on this website and follow the instructions under the “cancel membership” tab which can be found in the footer of the website.   Any cancellation requests that are made via email or messages via any social media platforms etc will not be accepted.  These same terms apply to membership cancellations made for 3-Monthly and 6-Monthly subscribers. 

Becoming a member of this site gives you non-transferable and non-exclusive access to all tutorials on this website strictly in accordance with all terms and conditions.  You are not permitted to use this website or any of its content for any purpose that is unlawful or against the terms and conditions.  You may not use this website or its content in any way that is harmful to any other user or to the owner of this site.  You are only allowed access to the information made available through this website and may not use any unlawful way to intentionally obtain information not provided by Nicola Jane Cupcake Bouquets.

Nicola Jane Cupcake Bouquets reserves the right to change the terms and conditions for all areas of this website.  The most current version of the terms and conditions will supersede any and all previous versions.  It is your responsibility to periodically check all terms and conditions and stay informed of all updates.

Nicola Jane Cupcake Bouquets may raise the monthly membership fee.  In such an event all members will be notified within a 60 day period by way of email.  The content of this email will include cancellation instructions should any member not wish to continue with their subscription to this website at the proposed price increase.
